1. General Terms of Use

This website and all content within are owned and operated by Kahiwa Design Studio (“we,” “us,” “our”).
By accessing our website, purchasing a service, or downloading any materials, you agree to these Terms and Conditions.

You must be at least 18 years old to engage in any paid service or product purchase from this website.

We reserve the right to modify these terms at any time. Continued use of this site constitutes your acceptance of any updates.

2. Intellectual Property Rights

All content on this website—including logos, designs, text, images, graphics, templates, and downloadable files—is the intellectual property of Kahiwa Design Studio unless otherwise credited.

You may not:

  • Copy, reproduce, or redistribute any materials without written permission.

  • Claim any design, image, or content as your own.

  • Use Kahiwa Design Studio’s work or website materials for resale or redistribution.

Violation of this policy may result in legal action.

3. Payment & Booking Policy

All services require a non-refundable 50% retainer to secure your booking. The remaining balance is due prior to final file delivery or project launch.

Accepted payment methods include:

  • Credit/Debit Card

  • PayPal

  • Bank Transfer

  • Zelle

Payments must be made in full before design files, websites, or digital materials are released.
Late invoices may incur a 5% late fee after 7 days past due.

4. Refund & Cancellation Policy

All payments made to Kahiwa Design Studio are non-refundable as they compensate for time, creative work, and resources already invested.

Refunds will only be considered under exceptional circumstances where no design or work has begun.

If a client cancels after work has started:

  • The retainer is forfeited.

  • Any completed work remains the property of Kahiwa Design Studio.

  • If the project is over 50% complete, no refunds will be issued.

Kahiwa Design Studio reserves the right to cancel any project for reasons such as non-payment, communication breakdown, or violation of terms. In such cases, clients will receive a fair prorated refund for incomplete work.

5. Turnaround Time & Client Responsibilities

Project timelines are based on prompt client responses, approvals, and content delivery.
Failure to provide required materials or feedback within 7 business days may result in project delays or rescheduling.

Projects inactive for 30 days without communication may be considered abandoned and closed without refund.

Clients are responsible for proofreading, reviewing, and approving all designs prior to printing or publication. Kahiwa Design Studio is not responsible for errors once proofs are approved.

6. Digital Products & Downloads

All digital templates, resources, or products purchased through this website are non-refundable and non-transferable.
You may not resell, distribute, or claim any downloadable item as your own work.

Purchases grant you a personal and/or business-use license — not resale rights.

7. Communication & Availability

Official communication must take place via email at hello@kahiwadesign.com or through approved project portals.

Business Hours:
🕘 Monday – Friday, 9:00 AM – 5:00 PM PST
📵 Closed on weekends and holidays (unless pre-arranged for rush projects).

Messages received outside business hours will be addressed on the next business day.

8. Confidentiality

All client information, business strategies, and project details are kept strictly confidential.
Kahiwa Design Studio will not share, publish, or disclose any information without written consent.

Similarly, clients agree not to share proprietary materials, pricing, or documents belonging to Kahiwa Design Studio without permission.

9. Portfolio Rights

Unless otherwise specified in a signed NDA, Kahiwa Design Studio reserves the right to showcase completed projects in portfolios, social media, case studies, or promotional materials.

This helps promote the studio’s creative services while respecting each client’s privacy and brand integrity.

10. Liability Disclaimer

Kahiwa Design Studio shall not be held liable for:

  • Any damages, losses, or issues resulting from the use of our designs, websites, or materials.

  • Printing errors after proof approval.

  • Client-supplied content (images, copy, or materials).

All recommendations, design concepts, and marketing materials are provided based on professional expertise — but success is not guaranteed.

11. Third-Party Links

Our website may include links to third-party websites or tools for your convenience.
We are not responsible for their content, policies, or practices.
Visiting these sites is at your own discretion.

12. Privacy Policy

We value your privacy. Any personal information collected (such as names, emails, or payment details) is used solely for communication, billing, and project management.

We do not sell, rent, or share your data with third parties.
All payment processing is handled securely through trusted platforms such as Stripe or PayPal.

13. Governing Law

These terms and policies are governed by and construed in accordance with the laws of the State of Nevada, USA.
Any disputes will be handled in the jurisdiction of Clark County, Nevada.
